These General Terms and Conditions (hereinafter: GTC) contain the rights and obligations of the Customer (hereinafter: Customer) using the e-commerce services provided by VIA-SPEED Kft. (hereinafter: Service Provider).

Furthermore, these GTC apply to all commercial transactions within Hungary that are concluded between the Parties defined in this agreement.
The Service Provider participates in the product order solely as an intermediary merchant, fulfilling an intermediary role only. The contract between the contracting parties for the products found on the website is concluded by implied conduct, by placing an order.

Purchases made in the Partner’s Webshop are regulated by Act CVIII of 2001 on certain issues of electronic commerce services and information society services (“Ektv.”), with the Service Provider having provided the information required by Sections 5(2) and 6(1)-(2) of the Ektv. through these GTC.

1.2. Purchases in the VIA-SPEED Kft. Webshop can be made by placing an electronic order, in the manner specified in these GTC.
The Customer acknowledges that the Service Provider does not, or not always, possess the products listed in the Webshop, and is present in an intermediary commercial capacity. The products and advertisements displayed in the Webshop are published and managed by the Service Provider on behalf of the Distributor.

1.3. Only the distributor has stock. The Distributor delivers the ordered product to the Service Provider. The Service Provider ships the product according to the delivery terms stated in the product description. The Service Provider provides service from the order of the product until its dispatch.

Product Prices

If, despite all due care by the Service Provider, an incorrect price appears on the Webshop interface, especially in cases of obviously erroneous prices, e.g., a price significantly different from the product’s well-known, generally accepted, or estimated price, or a “0” Ft or “1” Ft price appearing due to a system error, the Service Provider is not obliged to deliver the product at the incorrect price. Instead, the Service Provider may offer delivery at the correct price, in which case the Customer may withdraw from their purchase intention. We reserve the right to change prices!

Purchase

Purchasing on the site constitutes a contract concluded between the Operator and the Buyer/User.
The prices indicated next to each product are gross amounts, which do not include the cost of home delivery. No separate packaging fee is charged.
Before submitting your order, you can change and check the contents of your cart at any time by clicking on the appropriate link in the “Cart” panel. Add the items you wish to purchase to your cart, then click the “Order” button. The ordering process consists of four steps.

Our system automatically offers the shipping address and payment method recorded during the previous order and summarizes the products you have selected. With one click, you can accept or modify the order details, the shipping method, location, and payment method. If everything is in order and you accept the purchase conditions, all you have to do is click the “Order” button. This will confirm your order and send it to us.

 

 

 

Order Processing

Orders are processed on weekdays until 6:00 PM. Orders can also be placed outside the designated processing times; if placed after working hours, they will be processed on the following day. Our system will send an automatic email confirmation of your order, containing all its parameters. Our Customer Service will always confirm by phone or email when your order can be fulfilled. The general fulfillment deadline is within 5 business days from the confirmation.

We reserve the right to refuse confirmed orders, either partially or in full. Partial fulfillment can only occur after consultation with the customer! In case of advance payment for the product, the amount will be refunded to the sender.

Orders can be canceled by sending an email to info@blondhair.hu.

Registration

Browsing, viewing textual content or products does not require registration. However, you must register in the system before ordering any goods. During registration, you must provide your name, desired shipping address, email address, and phone number. Providing this data is a prerequisite for fulfilling the order. You can check and modify or delete the accuracy of your data at any time before approval. Data submitted with a specific order cannot be modified after submission. After providing your personal data, the system will send a confirmation to the email address you provided, repeating the data you entered during registration. Failure to deliver the email confirmation may be caused by an incorrectly provided email address or a full mailbox.

www.blondhair.hu uses the information you provide, in compliance with the relevant data protection law, solely for sending written information, facilitating the ordering process, and contacting you in case of a problem.

Payment Methods

Card payment is available in the webshop. Online card payments are processed through the Barion system. Card details are not transmitted to the merchant. The service provider, Barion Payment Zrt., is an institution supervised by the Hungarian National Bank, with license number: H-EN-I-1064/2013.

You can choose the payment method when placing your order. The total amount payable, based on the order summary and confirmation email, includes all costs. Cash payment is possible via cash on delivery. In this case, the value of the goods must be paid to the courier performing the delivery or at a parcel point. Please inspect the package in front of the courier upon delivery, and if any damage is found on the products, request a report to be made and do not accept the package. Subsequent complaints without a report cannot be accepted!

You can pay for your order in cash and pick it up at your chosen store.

We also offer the option to pay for the package value in advance.

Home Delivery and Personal Pickup

We deliver ordered products throughout Hungary.

Currently, we are unable to fulfill international deliveries.

Delivery is carried out by GLS courier service. Packages are delivered on weekdays between 8 AM and 5 PM. If you are not at home during this period, it is advisable (if possible) to provide a workplace address as the delivery address. The courier service attempts delivery twice; the shipping cost of undelivered packages will be charged to the customer! Only order the desired products if you can pay for them to the courier upon receipt of the package! In the case of undelivered, returned packages, the cost of return shipping will be charged to the customer.

 

Shipping fees: (Uniform rates within Hungary)

 

Gross total of ordered products: a shipping fee of 1500 Ft is payable, with an extra handling fee for cash on delivery.

 

The shipping cost is automatically calculated by the system based on the registered order amount, and the payable fee is also indicated at the end of the order in the checkout.
The thus calculated final purchase amount is payable, which collectively includes the value of the goods and the shipping fee.

 

Exception:

For orders over 10kg, we will contact the Customer, as in this case, the shipping fees specified above do not apply. In such cases, we will set a unique shipping fee depending on the nature of the package, which will be agreed upon with the Customer via email or phone.

 

You also have the option of personal pickup, allowing you to select one of our stores listed during your order. We will send you an email notification as soon as your order is ready for pickup.

IMPORTANT! If you choose personal pickup, please provide your order number and the name under which you placed the order when picking it up at the store.
The easiest way to do this, if possible, is to print the Purchase Order received via email and present it at the store, but this is, of course, not mandatory.
The value of products ordered in the Webshop and intended for personal pickup can be paid in cash.

Please note that we can hold your ordered products for a maximum of 5 business days. If the product is not picked up within the specified time, we unfortunately cannot guarantee later pickup. Of course, an exception is made if you notify us in writing or by phone that a later pickup time would be suitable for you!

We generally do not deliver on weekends. If you wish to receive your package on a weekend, please indicate this in the comments section during your order.

We generally undertake delivery within 5 business days.

If the ordered goods are in stock, we will ship them within 2-3 business days, so the product is expected to arrive within 3-5 business days.

If the ordered product is not currently in stock, the procurement process may take a few days, which could extend the home delivery time. If this is the case, we will notify you by phone or at the email address you provided.

Complaints, Warranty

In case of a quantitative and/or qualitative complaint regarding purchased products, the courier will return the disputed product, provided that the complaint was made at the time of handover. In the event of a legitimate complaint, our company will contact you to arrange a new delivery date. The cost of the new delivery will, of course, be borne by our company in this case. If you have any questions, comments, or problems regarding our company’s operations or the products we distribute, please share them with us. Feel free to contact us using any of the contact details indicated in the “Contact” menu on the website.

 

Right of Withdrawal:

In accordance with Directive 2011/83/EU of the European Parliament and of the Council, and Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses, the User may withdraw from the contract without justification within 14 days of receiving the ordered product and return it. In the absence of this information, the User is entitled to exercise their right of withdrawal for up to 1 year. When exercising the right of withdrawal, the consumer is not charged any costs other than the cost of returning the product; however, the business may claim compensation for material damage resulting from improper use.

  1. The period for exercising the right of withdrawal expires 14 days after the day on which the User, or a third party designated by them, other than the carrier, receives the product.
    2. The date of receipt in case of personal pickup is the date of personal pickup of the order, and in case of home delivery, it is the date of receipt from the courier. These can be proven by the invoice or the receipt from the courier.
    3. Please send the undamaged product back to the Operator’s address at your own expense, and we will refund the purchase price of the returned product(s) within 14 days. The cost of returning the product must be borne by the consumer; the business does not undertake to bear this cost.
    4. The refund also applies to the delivery cost.
    5. We are unable to accept packages returned with cash on delivery.
    6. If the customer has used the product and cannot return it to the Operator undamaged, the Operator will not repurchase the product. When exercising the right of withdrawal, the User is not charged any costs other than the cost of returning the product; however, the Service Provider may claim compensation for material damage resulting from improper use.

 

The right of withdrawal cannot be exercised in the following cases:

  1. In the case of a non-prefabricated product that was produced based on the consumer’s instructions or explicit request, or a product that was clearly tailored to the consumer’s person;
    2. In the case of a contract for the provision of services, after the complete performance of the service, if the business commenced performance with the consumer’s explicit, prior consent, and the consumer acknowledged that they would lose their right of termination after the complete performance of the service;
    3. In respect of a product or service whose price or fee depends on fluctuations in the financial market beyond the business’s control, even within the period available for exercising the right of withdrawal;
    4. In respect of perishable goods or goods with a short shelf life;
    5. In respect of sealed packaging that cannot be returned after opening for health protection or hygiene reasons;
    6. In respect of a product which, by its nature, becomes inseparably mixed with other products after handover;
    7. In respect of alcoholic beverages whose actual value depends on market fluctuations beyond the business’s control, and whose price was agreed upon by the parties at the time of concluding the sales contract, but whose performance will only take place after the thirtieth day following the conclusion of the contract;
    8. In the case of a service contract where the business visits the consumer at the consumer’s explicit request for urgent repair or maintenance work;
    9. In respect of the sale of a sealed audio or video recording, or computer software, if the consumer has opened the packaging after handover;
    10. In respect of newspapers, periodicals, and magazines, with the exception of subscription contracts;
    11. In the case of contracts concluded at a public auction;
    12. In the case of a contract for accommodation services (other than for residential purposes), transport, car rental, catering, or services related to leisure activities, if a specific date or period of performance is stipulated in the contract;
    13. In respect of digital content provided on a non-tangible medium, if the business commenced performance with the consumer’s explicit, prior consent, and the consumer declared, at the same time as giving this consent, that they acknowledged losing their right of withdrawal after the commencement of performance.

The User may also contact the Operator with other complaints using the contact details provided in these General Terms and Conditions.

The User is obliged to return the goods without undue delay, but in no case later than 14 days from the date of sending the notification of withdrawal from the contract to the Operator, or to hand them over at the Operator’s address. The User complies with the deadline if they return or hand over the product(s) before the expiry of the 14-day period. After the product is returned, the Service Provider will refund the paid amount to the User without delay, but no later than 14 days, in accordance with the above regulations.

Procedure for Exercising the Right of Withdrawal

If the Consumer wishes to exercise their right of withdrawal, they must send their declaration of withdrawal to one of the following contact details:

The Consumer exercises their right of withdrawal within the deadline if they send their declaration of withdrawal before the expiry of the 14th day from the receipt of the product. In case of written withdrawal, it is sufficient to send the declaration of withdrawal within 14 days.

In case of notification by post, the date of mailing is taken into account; in case of notification by email or fax, the time of sending the email or fax is considered.

In case of withdrawal, the Consumer is obliged to return the ordered product to VIA-SPEED Kft.’s address without delay, but no later than 14 days from the communication of their declaration of withdrawal. The deadline is considered met if the product is sent before the 14-day deadline expires (i.e., it does not have to arrive within 14 days). The customer bears the costs associated with the return of the goods due to the exercise of the right of withdrawal. The customer is not charged any other costs beyond this.

However, the Service Provider is not obliged to reimburse the Consumer for additional costs resulting from the Consumer choosing a delivery method different from the cheapest standard transportation method offered by the Service Provider. The Service Provider is entitled to withhold the refund of the full amount paid by the Consumer until it has received the product back, or the Consumer has credibly proven that they have returned it.

During the refund, the Service Provider uses the same payment method as was used in the original transaction, unless the Consumer explicitly consents to the use of another payment method; the Consumer incurs no additional costs as a result of using this refund method. The Consumer is only liable for any depreciation in value resulting from use exceeding what is necessary to ascertain the nature, characteristics, and functioning of the product.

The Consumer bears the burden of proving that the right of withdrawal is exercised in accordance with Section 20 of Government Decree 45/2014 (II. 26.).

In the case of the sale of multiple products, if the delivery of individual products occurs at different times, the buyer may exercise the right of withdrawal within 14 days from the receipt of the last delivered product, or in the case of a product consisting of multiple items or pieces, from the receipt of the last delivered item or piece. The Consumer may also exercise their right of withdrawal during the period between the date of concluding the contract and the date of receiving the product;

If possible, please return the product with the original invoice or a copy thereof, to assist our work.

  1. § (1) In the case of an off-premises contract and a distance contract, the consumer has the right to withdraw without justification within the deadline specified in paragraph (2). In the case of an off-premises contract and a distance contract for the provision of services, if performance begins after the declaration under Section 13 or Section 19, the consumer has the right to terminate without justification within the deadline specified in paragraph (2). (2) The consumer may exercise their right of withdrawal or termination under paragraph (1) within fourteen days from the day of receipt: a) in the case of a contract for the sale of goods, aa) of the product, ab) in the case of the sale of multiple products, if the individual products are delivered at different times, of the last delivered product, ac) in the case of a product consisting of multiple items or pieces, of the last delivered item or piece, ad) if the product must be delivered regularly over a specified period, of the first delivery, by the consumer or a third party designated by them, other than the carrier; b) in the case of a contract for the provision of services, from the day of concluding the contract. (3) The provisions of paragraph (2) point a) do not affect the consumer’s right to exercise their right of withdrawal specified in this Section during the period between the day of concluding the contract and the day of receiving the product.

Warranty for Defects, Product Warranty, Guarantee

  1. Warranty for Defects

In case of faulty performance by VIA-SPEED Kft., the buyer may assert a claim for warranty for defects against VIA-SPEED Kft. according to the rules of the Civil Code.

The Buyer is obliged to notify the defect without delay after its discovery, but no later than two months from the discovery of the defect. In the case of a consumer contract, the buyer may assert their warranty claims within 2 years from the date of receipt for product defects that already existed at the time of handing over the product.

Beyond the two-year limitation period, the buyer cannot assert a claim for warranty for defects. When asserting the right to warranty for defects, the Buyer may request repair or replacement, unless fulfilling the demand chosen by the Buyer is impossible or would incur disproportionate additional costs for the business compared to fulfilling another demand.

If you have not requested, or could not request, repair or replacement, you may demand a proportional reduction of the consideration, or you may repair the defect yourself at the business’s expense, or have it repaired by someone else, or – as a last resort – you may withdraw from the contract.

The Buyer may switch from one chosen right of warranty for defects to another, but in this case, the Buyer must bear the cost of the switch, unless it was justified or caused by the business. Within six months from performance, there are no other conditions for asserting a claim for warranty for defects beyond notifying the defect, provided the Buyer proves that VIA-SPEED Kft. provided the product or service. However, after six months from performance, the Buyer must prove that the defect identified by the Buyer already existed at the time of performance.

  1. Product Warranty

In case of a defect in movable property (product), the Buyer can decide whether to assert the right to warranty for defects, as described earlier, or a product warranty claim. As a product warranty claim, the Buyer can only request the repair or replacement of the defective product. A product is considered defective if it does not meet the quality requirements in force at the time of its placement on the market, or if it does not possess the properties stated in the description provided by the manufacturer.

The Buyer may assert their product warranty claim within two years from the product’s placement on the market by the manufacturer. After this deadline, the Buyer loses this entitlement. The Buyer may exercise their product warranty claim exclusively against the manufacturer or distributor of the movable property. The Buyer must prove the product’s defect when asserting a product warranty claim.

The manufacturer (distributor) is exempt from its product warranty obligation only if it can prove that:

The manufacturer (distributor) only needs to prove one reason for exemption. Please note that you cannot assert claims for warranty for defects and product warranty simultaneously for the same defect. However, if your product warranty claim is successfully asserted, you may assert your claim for warranty for defects regarding the replaced product or repaired part against the manufacturer.

  1. Guarantee

If the guarantee request is valid, the buyer may request the product’s replacement or repair. If we are unable to replace the product due to lack of stock, the option of repair remains. It is possible to request a price reduction or a refund of the purchase price if neither replacement nor repair of the product is possible. If the Buyer asserts their claim for replacement due to product malfunction within three business days from the handover of the product, VIA-SPEED Kft. is obliged to replace the product, provided that the malfunction hinders its intended use. You can report your warranty or guarantee claim for purchased products in person, by mail, or by email.
